You need to pull in the latest patches from https://projects.archlinux.org/svntogit/packages.git/tree/trunk/linux-3.8.patch?h=packages/nvidia for the 3.8 kernel

You need to patch conftest.sh for this to work with the latest kernels above 3.7.5 Line 1704 needs to be changed : - -a -n "$SUBLEVEL" -a $SUBLEVEL -le 5 ]; then + -a -n "$SUBLEVEL" -a $SUBLEVEL -le 8 ]; then

please don't rm and mv in the build section... follow the template from the non beta https://aur.archlinux.org/packages/dk/dkms-nvidia/PKGBUILD
